1. Acceptance of Terms

These Terms & Conditions govern your access to and use of the merryph online gaming platform, including all games, features, promotions, and services made available through merryph.one (the "Platform"). These Terms apply to all visitors, registered users, and any other persons who access or use the Platform.

By registering an account with merryph, clicking "I Agree," or otherwise accessing the Platform, you confirm that you have read and understood these Terms and agree to comply with them. Your continued use of the Platform following any modification to these Terms constitutes your acceptance of the revised Terms.

These Terms should be read in conjunction with our Privacy Policy and our Responsible Gaming Policy, both of which are incorporated herein by reference and form part of the overall agreement between you and merryph.

2. Eligibility

To be eligible to use the merryph Platform, you must satisfy all of the following conditions:

• You are at least 21 years of age at the time of registration and at all times during your use of the Platform.
• You are a resident of or physically located in the Republic of the Philippines at the time of accessing the Platform.
• You are accessing the Platform for personal, recreational purposes only and not on behalf of any third party.
• You are not a current employee, contractor, director, officer, or agent of merryph, nor an immediate family member of any such person.
• You are not prohibited from participating in online gaming activities under any applicable law, regulation, or court order.
• You have not previously been self-excluded from the merryph Platform or any other gaming platform under a self-exclusion agreement that remains in effect.
• You are acting in your own name and not as a nominee or agent for any other person.

merryph reserves the right to verify your eligibility at any time. Failure to meet any of the above conditions constitutes a material breach of these Terms and may result in immediate account suspension, forfeiture of balances, and referral to relevant authorities where required by law.

3. Account Registration & Security

To access the full range of merryph services, you must register a player account. Each individual may hold only one (1) active account on the Platform. The creation of multiple accounts by a single individual is strictly prohibited and may result in the permanent closure of all associated accounts and forfeiture of any balances therein.

During registration, you agree to provide accurate, current, and complete information, including but not limited to:

• Your full legal name as it appears on a valid government-issued identification document.
• Your date of birth, confirming you are 21 years of age or older.
• A valid and active email address that you own and control.
• A valid Philippine mobile number.
• Your current residential address within the Philippines.

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify merryph immediately at [email protected] if you suspect any unauthorized access to or use of your account. merryph will not be liable for any loss or damage arising from your failure to safeguard your account credentials.

merryph reserves the right to conduct identity verification ("KYC" — Know Your Customer) procedures at any time, including at the point of registration, prior to processing withdrawals, or upon reasonable suspicion of fraudulent activity. You agree to cooperate fully with any such verification process and to provide any documentation reasonably requested by merryph within the timeframe specified.

4. Deposits & Withdrawals

merryph supports the following payment methods for deposits and withdrawals, all denominated in Philippine Peso (PHP / ₱): GCash, PayMaya / Maya, and bank transfers via BPI, BDO, Metrobank, UnionBank, Landbank, PNB, and Security Bank. Debit cards linked to eligible Philippine bank accounts may also be accepted where available.

All funds deposited into your merryph account must originate from a payment method registered in your own name. The use of payment methods belonging to third parties is strictly prohibited. merryph reserves the right to return funds to the source payment method and to suspend accounts where third-party funding is detected.

• Minimum Deposit: ₱100 per transaction, subject to change at merryph's discretion with prior notice.
• Withdrawal Processing: Withdrawal requests are processed within one (1) to three (3) business days, subject to completion of identity verification and compliance checks.
• Withdrawal Limits: Minimum and maximum withdrawal amounts apply and are displayed within your account dashboard. These limits may be adjusted based on your account verification status and transaction history.
• Currency: All transactions on the merryph Platform are conducted in Philippine Peso (PHP). merryph does not accept or process transactions in foreign currencies or any form of cryptocurrency.

merryph reserves the right to delay or withhold withdrawal processing pending the completion of identity verification, investigation of suspected fraudulent activity, or compliance with applicable anti-money laundering regulations. In such cases, merryph will notify you of the delay and the reason therefor to the extent permitted by law.

5. Bonuses & Promotions

merryph may, from time to time, offer bonuses, free spins, cashback, reload promotions, and other incentives to registered players. All bonuses and promotions are subject to specific terms and conditions that will be communicated at the time the offer is made. In the event of any conflict between the specific promotion terms and these general Terms, the specific promotion terms shall prevail.

General conditions applicable to all merryph bonuses include:

• Bonuses are available to eligible registered players only. merryph reserves the right to determine eligibility at its sole discretion.
• Unless otherwise stated, all bonuses are subject to a wagering requirement that must be fulfilled before any bonus-derived winnings may be withdrawn. The applicable wagering requirement will be specified in the promotion terms.
• Bonuses may only be used for the games and game categories specified in the promotion terms. Use of bonus funds on excluded games will not contribute to wagering requirements.
• merryph reserves the right to withdraw, modify, or cancel any bonus or promotion at any time, with or without prior notice, where there is evidence of abuse, exploitation, or technical error.
• Players who are found to be abusing the bonus system — including through the use of multiple accounts, coordinated play, or any other method designed to exploit promotional offers — will have their bonuses forfeited and their accounts suspended.

6. Gameplay Rules & Fair Play

All games available on the merryph Platform use certified Random Number Generator (RNG) technology, independently audited to ensure fairness and unpredictability of outcomes. The results of all games are final and binding once confirmed by the Platform's system. merryph does not manipulate game outcomes in any way.

In the event of a discrepancy between the result displayed on your device and the result recorded on merryph's servers, the server-side record shall be deemed authoritative and final. merryph's decision on any disputed game outcome is final and binding, subject to the complaints procedure set out below.

If a game is interrupted due to a technical failure, disconnection, or system error before a round is completed, merryph will endeavor to resolve the situation fairly. Where a round cannot be completed and the outcome cannot be determined, the wager for that round will be returned to your account balance. merryph is not liable for losses arising from technical failures beyond its reasonable control.

Players are responsible for ensuring that their use of the Platform complies with all applicable laws in their jurisdiction. merryph makes no representation that the Platform is lawful or available for use in any jurisdiction outside the Philippines.

7. Prohibited Conduct

The following conduct is strictly prohibited on the merryph Platform. Violation of any of these prohibitions may result in immediate account suspension, forfeiture of balances, and referral to law enforcement authorities:

• Registering more than one account, or registering an account on behalf of another person.
• Providing false, inaccurate, or misleading information during registration or at any other time.
• Using the Platform if you are under 21 years of age.
• Using automated software, bots, scripts, or any other artificial means to interact with the Platform.
• Exploiting software bugs, errors, or vulnerabilities in the Platform for financial gain. Any such exploitation must be reported to merryph immediately.
• Engaging in any form of collusion, match-fixing, or coordinated play designed to gain an unfair advantage.
• Using the Platform for any money laundering, fraud, or other illegal financial activity.
• Attempting to reverse-engineer, decompile, or otherwise tamper with the Platform's software or systems.
• Harassing, threatening, or abusing other players or merryph staff through any communication channel.
• Charging back or reversing any deposit transaction after using the deposited funds for gameplay.

8. Responsible Gaming

merryph takes its responsible gaming obligations seriously and complies with PAGCOR's responsible gaming guidelines. We provide the following tools to all registered players:

• Deposit Limits: Set daily, weekly, or monthly deposit limits on your account to control your spending.
• Session Time Limits: Set a maximum session duration after which you will be automatically logged out.
• Reality Checks: Receive periodic notifications during gameplay reminding you of the time elapsed and amount wagered.
• Self-Exclusion: Request a temporary or permanent self-exclusion from the Platform. During a self-exclusion period, your account will be suspended and you will not be permitted to register a new account.
• Cool-Off Period: Take a short break from the Platform for a defined period without permanently closing your account.

9. Intellectual Property

All content on the merryph Platform — including but not limited to text, graphics, logos, icons, images, audio clips, game software, and the overall design and compilation of the Platform — is the property of merryph or its content suppliers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial recreational purposes only. This licence does not include the right to: reproduce, distribute, publicly display, or create derivative works from any Platform content; use any data mining, robots, or similar data gathering tools; or frame or mirror any part of the Platform without merryph's prior written consent.

The merryph name, logo, and all related marks are trademarks of merryph. You may not use these marks without the prior written permission of merryph.

10. Limitation of Liability

To the fullest extent permitted by applicable law, merryph, its directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Platform, including but not limited to loss of profits, loss of data, loss of goodwill, or service interruption.

merryph's total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the total amount deposited by you into your merryph account in the thirty (30) days immediately preceding the event giving rise to the claim.

The Platform is provided on an "as is" and "as available" basis. merryph makes no warranties, express or implied, regarding the Platform's availability, accuracy, reliability, or fitness for a particular purpose. merryph does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Privacy & Data Protection

merryph collects, processes, and stores your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and processing of your personal data as described in the Privacy Policy.

merryph implements industry-standard security measures, including 256-bit SSL encryption, to protect your personal and financial data. However, no method of transmission over the internet is completely secure, and merryph cannot guarantee the absolute security of your data.

merryph may be required to disclose your personal data to regulatory authorities, including PAGCOR, law enforcement agencies, or financial intelligence units, where required by applicable Philippine law or regulation.

12. Account Suspension & Termination

merryph reserves the right to suspend, restrict, or permanently close your account at any time, with or without prior notice, for any of the following reasons:

• Breach of any provision of these Terms.
• Provision of false or misleading information during registration or verification.
• Suspected fraudulent activity, money laundering, or other illegal conduct.
• Failure to complete identity verification within the required timeframe.
• Receipt of a self-exclusion request from you or a responsible gaming authority.
• Regulatory requirement or instruction from PAGCOR or any other competent authority.

Upon termination of your account, any pending withdrawal requests that have passed compliance checks will be processed in the normal course. Balances associated with accounts closed due to breach of these Terms, fraud, or other prohibited conduct may be forfeited at merryph's discretion.

You may close your account at any time by contacting merryph support. Account closure requests are processed within five (5) business days. Closing your account does not affect any rights or obligations that accrued prior to closure.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. The merryph Platform operates within the regulatory framework established by the Philippine Amusement and Gaming Corporation (PAGCOR).

In the event of any dispute arising out of or in connection with these Terms or your use of the Platform, you agree to first contact merryph's customer support team to seek an informal resolution. merryph will endeavor to resolve all complaints within ten (10) business days of receipt.

If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of the Philippines. You irrevocably waive any objection to the exercise of jurisdiction by such courts.

14. Amendments to These Terms

merryph reserves the right to amend, update, or replace these Terms at any time. When material changes are made, merryph will notify registered players via email or a prominent notice on the Platform at least seven (7) days prior to the changes taking effect, except where immediate changes are required by law or regulatory directive.

Your continued use of the Platform after the effective date of any amended Terms constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must cease using the Platform and may request account closure in accordance with Section 12.
